Judge Chandler had Venet and Bachemin arrested this evening for refusing to testify in court. Wood, Scherck and Wilson were atsent, or they would have shared the same fate. Nay 16, 1871*, issue quoting from the "Sea Coast Rermtlican" Ex parte Louis Scherck. J. B. Vienes, and Z Bachemin, -when they made their appearance two days ago, the F. 0. pap°rs having disclosed the fact that they were mere spectators of the duel, the Grand Jury called them in as witnesses, and they atsolutely x refused to testify. They claimed the section of the Dueling Act under which they were required to testify was in violation of the clause of the Constitution which protected them from teing compelled to give evidence against themselves. (5th Amendment). On Thursday evening, Kay 1^, the question w?s argued with great ingenuity, utility and eloquence. District Attorney Seal sooke for the State, and Col. Wood of Pasqaeoula, and Kr. Castellanos, a distinguished criminal lawyer from IT.0.,for the defendants. The court held the law constitutional and directed the defendants fce returned to the Grand Jurv. When thj?y again refused to give evidence, each was sentenced to pay’a fine of $200, and to te imprisoned in the County Jail until the final adjournment of the Court, and for ten days thereafter. After trying the Jail one night, on Friday morning they gave their evidence. In a short while a till of indictment was returned against Wood and Bachemin, and all seconds and surgeons on toth sides, and the case set for trail on Saturday morning. Gov. Adeltert An.-S attended the trial at Bay St. Louis.- Kay 9 the entire party was acquitted. The C.H. was crowded with ladies. Mr. Judge Chandler stated after the verdict, under Kiss, dueling laws conviction could te had only incase of death.
