Agreement between J. F. H. Claiborne and
Robert H. S. Martin
Articles of Agreement entered into this 17th day of March A. D. 1870 between J. F. H. Claiborne attorney of Martha D. Claiborne of the one part and Robert H. S. Martin for himself and for Ann S. Smith both of the County of Claiborne and State of Mississippi of the other part "WitnaMeth that the amid J.F. H. Claiborne for himself and as attorney for Martha D. Claiborne, his wife, acting by Power of Attorney from the aaidl Martha to the Mid J.F. Claiborne, duly recorded in the Clerk's Office of the County of Hancock in the State aforesaid on the 13th day of August A. D. 1866 hereby for and in consideration of one thousand dollars to him in	laid, the receipt whereof is hereby acknowledged and for the
furthax consideration stated hereinafter have bargained and sold to the said Ann S. Smith the tract of land known as the Anchorage place, hereto fore the residence of the said J. F. H. Claiborne and Martha his wife being the same land acquired by purchase by said Martha of BernardBourgeois as witnessed by deed from said Bourgeois to said Martha duly recorded in the Clerk's office of said county of Hancock, lying and being on the Mississippi Sound in the County and State aforesaid adjoining the lands of Maxlmllar Bourgeois Pierre Carvers lands formerly owned by Constantine B. Beverly and lands entered by Robert Montgomery.containing 50 acres (fifty acres) more or lesa, with all the Improvements and heriditaments thereto belonging. And the said J.F.H. Claiborne for himself and for Martha D. Claiborne whose attorney he is, bind himself in his own right and attorney to put the said Martin and Ann S. Smith or their authorized agent or assigns in full lawful and peaceable possession of said premises whenever they may demand possession of the same and hereby covenants and agrees then and there to make them a fee simple title to the same in general warranty against any claims from themeselves or their heirs or any person or persons whatsoever,
2nd, and the said Robert H. S. Martin for himself and the said Ann S. Smith
hereby bind themselves covenant and agree on receiving possession of said .

dollars due the 17th day of March 1871 ene note for the same amount due on the 17th day of March 1872 and one note for the same amount due the 17th day of March 1873, all bearing interest from the 17th of March 1871, at the rate of 8 per cent per annum, and to be received by a deed of trust to be duly executed by the said Ann S. Smith to the said Martha D. Claiborne on the day that she the said Ann S. Smith receives her title and possession of said premises. And the said parties by these presents hereby bind themselves one to the other, in the penal sum of Five Thousand Dollars punctually and full£, to comply with this agreement.
