1 the Zoning and Code Enforcement Officer, Such appeal shall be taken not more than sixty (60) days from the date of the decision of the Zoning and Code Enforcement Officer by filing a notice of appeal with the Zoning and Code Enforcement Officer. Every appeal or application shall refer to. the specific provision of the ordinance involved and shall set forth the interpretation that I is claimed, the use for which a special exception is sought, or the details of the variance that is applied for and the grounds upon which it is claimed that tlie variance sliall be granted, as the case may be, and accompanied by a plat or plan, drawn to scale, showing the actual dimensions of the parcel of land to be built upon and used, the size of any building to be erected, and the location of the building upon the lot, the materials to be used and other such information as may be deemed necessary to provide full information regarding intended use. The Zoning and Code Enforcement Officer shall forthwith transmit the appeal or application to the Board together with all papers constituting the record upon which the action appealed from was taken. The Board of Adjustment shall fi_x a reasonable time for the hearing of appeals or other matters referred to it, and give at least fifteen (15) days notice thereof, as well as due notice to the parties in interest, and decide the same within a reasonable time. Upon a hearing, any party may appear in person, or by agent, or by attorney. Section 1004. STAY OF PROCEEDINGS An appeal stays all legal proceedings in furtherance of the action appealed from, unless the Zoning and Code Enforcement Officer certifies to the Board of Adjustment after the notice of appeal shall have been filed with him that, by reason of facts stated in the certificate a stay would, in his opinion, cause inriinent peril to life and property. In such case, proceedings shall not be stayed otherwise than by a restraining order which may be granted by the Board of Adjustment or by a court of record application, on due notice to the Zoning and Code Enforcement Officer form whom the appeal is taken and on due cause shown. Section 1005. POWERS AND DUTIES OF THE BOARD OF ADJUSTMENT The Board of Adjustment shall have the following powers and duties; 10^5.1 Administrative Reviews To hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by the Zoning and Code Enforcement Officer in the enforcement of this ordinance. 1005.2 Special Exceptions To hear and decide special exceptions to the terms of this 62.
