I declare that this parcel contains my last wishes and will which I deposit in the hands of WILLIAM NAR-CIPE BROUTON, my friend, recommending to him to make it public right after my death. New Orleans, May 18, 1812.
SIMON FAVRE.
In the name of the FATHER, SON and HOLY GHOST, AMEN.
I, SIMON FAVRE, citizen, native of MOBILE, having always lived as a good Christian, and wishing to die in GRACE, as death may take me away at any time, and while I am in perfect health, strong of body, I am going to make my will, and do it in the following manner. First, I recommend my soul to GOD, and I ask that after my death, my body be carried to the most humble place, and that it will be given the resting place in a location that my executor will deem most fitting, the disposition with whom I leave funeral arrangements. It is thus my will.
ITEM. I state that I am married to a lady named CELESTE ROUCHON, and from this marriage we have five children named JEAN FAVRE, AUGUSTINE, ONEZAN, EUCHARIST, and MARGUERITE FAVRE. These I assert to be legtimate, and born during our marriage. may be confirmed.
ITEM. I assert I have certain debts which I request the legal executor of my will to pay ? also to receive certain sums of money due me and that he will use them in the best interest of my family.
ITEM. I have several parcels of land, left me by ENGLISH RELATIVES 1200 acres (French acre equals 1 and V-j ENGLISH acre, or if they used the old hector, that would be two and slightly less than Y> an ENGLISH acre. Mrs. Eccles, French Translator) on the LITTLE RIVER PEARL; 800 acres on the BIG RIVER, both from my father; another 1200 acres on the same river which was granted to me by the SPANISH government, 800 acres which I have under cultivation; also 800 acres in a place ONACAYA, which land of 400 acres I have acquired from Mon. Simon Endy, 400 acres on the river at a place named LaBoutelle, coming from my ENGLISH relatives. I also have the land which have been given to me by the INDIANS on the river which my EXECUTOR will either sell or conserve in their natural state as he may judge to be in the best interest of my family.
ITEM. I give to SIMON FAVRE, 12 years old, REBECCCA AUSTON?S son, the sum of 1500 Piastres when he will come of age. I also have for him the sum of 3300.47 piastres and 3 veaus, coming from his MOTHER?S assets, which shall be given to him when he will come of age. I wish that he will be taught to read and to write and to.learn a trade or a profession. This is my will.
ITEM. I want my wife CELESTE to be my children?s tutor. Such is my wish.
ITEM. I name as EXECUTOR of my will WILLIAM ARMAN DUPLANTIER PERRE WHO, WITH MY WIFE, GIVE joint judicial authority to receive, to sell, force sale, take in receipts, make any and all kinds of contracts which might be deemed necessary for the best interest of my family, and all the business which might have to do with my family. The bills to be paid must be approved and sanctioned by a Judge following my wife?s and EXECUTOR?S acknowledgement of their validity.
ITEM. I name as guardian for my children HON. FORGUS DUPLANTIER, to whom I ask, along with my EXECUTOR, to watch out for the interests of my family (children) and especially recommend to them that the said children get the best education. SUCH is my will. I assert that my sole and unique inheritors to my estate to be my children, which estate after my death shall be divided equally among them when they come of age. For this reason, after my death, an inventory must be made of all my worldly goods ? the appraisers will be chosen by my wife, my legal executor, and the appointed GUARDIAN. Of this inventory (estimated) it will be determined the amount which each child will receive after deducting of course the part which belong to their MOTHER to whom I give half of what we have acquired together, she having aided me by her economy and industriousness. I bequeath to my wife la YOMPANCE (an old French word which means management, I believe Mrs. Eccles, Translator) of my worldly goods, and I wish as they may come of age she will give each one of them that which they are due.
ITEM. I assert by this present document to destroy, to annul, all former wills or codiciles which I might have made before this, on May 18, 1812. Signed: SIMON FAVRE.
