Gentlemen:
We represent Mrs. Elizabeth Sullivan and others who wish to appear and object to the application. This pier is the subject of a lawsuit now pending in the Chancery Court of Hancock County, Mississippi wherein it is objected that the pier has interfered with the rights of the littoral owners in that it has caused the collection of slush and mud along the beaches which has made the beaches unattractive and unsuitable for recreational purposes. There is an agreement between counsel that the County Engineer will furnish proposals for the opening of the pier in such manner as to permit the free flow of the tides and the restoration of the beach to its natural condition.
It is further believed that the northern tip of-the extremity of this pier may intrude upon the property of littoral owners to the north.
