C.	Anyone desiring to take action within an Historic Preservation District for which a building permit from the Department of Planning and Inspection of the City of Bay St. Louis is not otherwise required shall apply for a Certificate of Appropriateness directly to the Commission by making an application containing (i) a description of the subject property and its location within the Historic Preservation District, (ii) a description of the action sought to be taken, (iii)
an explanation of how the action is to be accomplished and (iv) such information and exhibits as may be required by the Commission. Thereafter, the procedure will be the same as where a building permit is otherwise required.
D.	Whether a building permit is otherwise required or not, after a Certificate of Appropriateness has been issued, the City Clerk and Building Inspector of the City of Bay St. Louis shall have the authority to inspect the work in progress to ensure compliance with the plans, specifications and other conditions upon which the Certificate of Appropriateness was issued.
E.	Prior to filing an application for a Certificate of Appropriateness, upon request and in accordance with any regulations promulgated by the Commission, applicants shall have the right to consultation and conference with the Commission for the purpose of determining compliance with the requirements of this ordinance.
F.	A fee of twenty ($20.00) dollars shall accompany the filing of any application for a Certificate of Appropriateness and no application shall be considered by the Commission until such fee is received. Proceeds of receipts of said fees shall be maintained and administered in a separate account, from which shall be paid all costs of operation of the Commission and any and all other expenses incurred in the administration of this ordinance.
SECTION 13:	DENIAL	OF CERTIFICATION OF APPROPRIATENESS
A.	Applications for Certificates of Appropriateness shall be denied only upon determination by the Commission that the proposed changes would (i) result in such disharmony of scale and/or style between the proposed project and its immediate surroundings and the historical preservation and development districts as a whole as to undermine the architectural integrity and character of the historical preservation and development district and inhibit the accomplishment of the purposes of this ordinance, or, (ii) result in such a change in the architectural design or character of an existing building or improvement as to undermine the architectural design or character of such existing building or improvement and inhibit the accomplishment of the purposes of this ordinance, or (iii) result in the loss of or irreperable harm to
an existing building or improvement or architectural or historical significance.
B. In cases in which the Commission shall disapprove an application for a Certificate of Appropriateness, the written denial thereof shall include specific reasons for such denial and recommendations allowing qualification. The Commission may approve such application in any case where the owner would suffer extreme hardship, not including loss of profit, unless the Certificate of Appropriateness were issued forthwith.
